Use the words 'against equity and good conscience and any who have had multiple health plans and any indication of wrong doing, file it if you think you should do so. I did speak to one at CMS in Baltimore today who was aware of this portion of the law.A few do know.. And SSA agreed to do these back in 2005 but unknown if they have begun yet. MEDICARE HAS A GENEROUS LEGAL OPTION SO ONE CAN GET HEALTH CARE PAID FOR AND THE GOVT IS SUPPOSED TO STOP THE ILLEGAL BEHAVIORS ON THE PART OF OTHERS. Its very simple , the medical biller codes it as a conditional payment and asks medicare to pay as something is awry none of us can stop. Medicare pays and medicare ( all through the govt contractors) sends out a 'collections' letter to the primary, you get a copy and so does your doctor, etc. and this starts a legal process to get the money back and other govt agencies and officials and govt contractors are not immune from the law either. IF THEY DO NOT OBEY THE LAW, THEY CAN BE FINED A $1000 a day unitil the law is obeyed. AND IF THE OFFICIALS IN CHARGE OF OTHER GOVT HEALTH PLANS TO DO NOT MAKE THEIR GOVT CONTRACTORS PAY UP THEN THEY ARE RESPONSIBLE FOR THE ILLEGAL ACTIONS OF THEIR GOVT CONTRACTORS.
IN THE PROCESS CROOKS MIGHT BE DISCOVERED INSIDE THE GOVT AND THEY CAN BE PROSECUTED CRIMINALLY.
This law is very powerful when enforced. Its been highly suspected for some time that high level officials have given contracts for the purpose of theft and kick back bribes and some of those now in charge my be overseeing what was put in place a decades ago. as some indications have occurred in one area a billion dollars may have gone missing. Guess one has to have susffured and think something was going to be done to help and see it not happen as the one in charge was stopped form making any change for the better. I m not endorsing Eric Holder for all things, but he was right in trying to do something and pray he does continue. THE CROOKS DON'T WANT HIM TO DO IT.

Medical billing personnel not having any way of knowing A Blues policy exists unless they try to bill in the wee hours of every other Tues morning before e they get to work and hit the key for the huge data base to alter so many patents's records and allow the theft to continue. HHS HAS DONE NOTHING TO SHUT THIS DOWN FOR 12 YEARS SINCE OUR HEATH CARE BEGAN TO BE AFFECTED BY IT AND NO MEDICAL PROVIDERS ALLOWED TO KNOW WHOM TO BILL FOR PAYMENT. CHAOS LIKE THIS IS NOT EFFICIENT AND NOT THE GOOD HEALTH CARE OUR MEDICAL SOURCES CAN PROVIDE IF THEY WERE NOT FORCED TO PAY FOR THE FRAUD PUT OUT BY THE GOVT AND ITS ENTITIES. AT ALL.
I'm exhausted for being told I have to straighten out the whole govt in order to have the medical care for self and family in order to stay alive. I pray that those in charge take charge and do it pronto. And please do not listen to gossip and rumor as that is rampant and has been leading the way for way too long from one entity to the other in all of this. .
